1Purpose and acceptance
These terms of use set the conditions under which Tokenacademy ("we") makes its platform available, and under which any person uses it ("you").
Creating an account or signing in means you accept these terms. If you do not accept them, do not use the platform. We may update them; the version in force is the one published on this page, and we tell organizations of any material change before it applies.
2The service
Tokenacademy is a training platform: in guided sessions, a learner builds a web page or an AI agent by talking with a real AI agent, in a cloud environment set up for the session. The platform counts the tokens each request uses, checks each milestone and gives feedback. Learning designers make sessions in the Studio.
We take all reasonable care to keep the platform available and working, as an obligation of means. It may be interrupted for maintenance, updates, or reasons outside our control, including the unavailability of an AI or cloud provider.
3Organizations and commercial terms
Tokenacademy is sold to organizations only. Your access is provided by your employer or another organization ("your organization"), under a contract between it and us. That contract (order form, commercial terms and data processing agreement) sets the price, duration, number of learners, service levels and liability between your organization and us, and prevails over these terms where they differ.
Your organization decides who may sign in (by invitation code or company sign-in), which sessions and learning paths you are given, and who in it may see your progress. When its contract ends, your access ends with it.
4Your account
You give accurate information when you create your account and keep your password confidential. Your account is personal: do not share it. Tell your organization's Tokenacademy administrator, who passes it on to us at once if you think someone else has used it; you can also sign out of every browser from your profile.
Within your organization, other learners can see your name, photo, profile, rank on the leaderboards and the pages you build. People outside your organization cannot.
5Acceptable use
You agree not to:
- enter into the platform sensitive personal data (health, political opinions, religion, and the other categories of article 9 of the GDPR), other people's personal data, or your organization's confidential information, unless your organization has allowed it;
- use the platform or its agents to produce unlawful, hateful, defamatory or infringing content, or malware;
- try to get around the token budgets, the sessions' limits or the security of the platform and its cloud environments;
- use the cloud environments for anything other than the session (mining, scanning, sending email, attacking other systems);
- copy, resell or extract the platform's sessions and content, or access the platform by automated means.
We may suspend an account that breaks these rules, after telling your organization except in an emergency.
6Working with AI
The agents, the coach and the checks rely on AI models provided by third parties (see the privacy policy). What they write can be wrong, incomplete or unsuitable: check it before you rely on it outside the platform. A milestone validated or a score is a training assessment, not a certification of skills, unless your organization's contract says otherwise.
What you type in a session, and the files of your project, are sent to these models to answer you. Under their commercial terms, the providers do not use them to train their models.
7Your content and ours
What you write and build on the platform (your requests, your pages, your agents, your sessions in the Studio) is yours or your organization's, as your employment and your organization's contract provide. You grant us the right to host, process and display it to the people allowed to see it, only to provide the service.
The platform, its sessions, exercises, starting files, texts and interface belong to Tokenacademy (see the legal notice). You may use them for your training, for as long as you have access.
8Liability
We are liable for the service under the contract with your organization. Towards you, as a user, we are liable only for direct damage caused by our fault; we are not liable for the use you make of what you build or learn, of the agents' answers, or for damage caused by a provider's outage or by force majeure (article 1218 of the French Civil Code).
Nothing in these terms limits liability that the law does not allow to be limited.
9Governing law and disputes
These terms are governed by French law. They are written in English; a translation may be provided for convenience.
In case of disagreement, write to us first, through your organization's Tokenacademy administrator, who passes it on to us: we look for an amicable solution within thirty days. Failing that, the courts of Paris have jurisdiction, subject to any mandatory rule giving it to another court.
